For the purpose of determining the European Union (EU) Combined Nomenclature (CN) code for a product, the binding tariff information (BTI), which is legally binding on all customs administrations on the territory of the EU, may be obtained for a period of 3 years from the date of its entry into force.

Process description

  1. Service requests
    In order to receive BTI, the State Revenue Service (hereinafter - SRS) applies for access to the European binding tariff information system (eBTI - EU Trader Portal) via the SRS Electronic Declaration System (EDS) (https://eds.vid.gov.lv/login/ - Connect to the European Information Systems - European binding tariff information (eBTI - EU Trader Portal) - Applications - New application).

    The customs authority shall check within 30 days whether all the conditions for accepting the application are fulfilled. The customs authority shall notify the applicant of the acceptance of the application. If the conditions for accepting an application are not fulfilled, the applicant must rectify the shortcomings within 30 days at the latest or the customs authority shall not accept the application and notify the applicant thereof.

    The date of receipt of the application shall be the date on which the customs authority has received all the information necessary for taking the decision.

    In addition, the European binding tariff information for the use of the EDS system must be submitted to the EDS user by “Application for a European binding information on the user (s) of the tariff system (eBTI - EU Trader Portal)”.

    In order to determine the exact EU CN code, it is necessary to add the following information to the BTI application:
    1) the manufacturer's information regarding the quantities of raw materials used in the production process of the product;
    2) the manufacturer's information regarding the physicochemical properties of the product and the raw materials used in its manufacture (quality passports or quality certificates);
    3) the manufacturer's information regarding the chemical composition of the finished product;
    4) a description of the manufacturing technological process;
    5) information regarding the functions of the goods and the principle of operation;
    6) information regarding the intended use of goods;
    7) documents certifying the trade transaction (import/export) or planning thereof (e.g. supply contract, correspondence of undertakings, etc.);
    8) if necessary, a sample test report issued by a competent laboratory.

  2. Receipt of services
    The decision shall be communicated to the addressee via the SRS Electronic Declaration System (hereinafter EDS).
    The decision shall be registered in the European binding tariff information system and the information shall be available to the addressee via the SRS EDS.
